These Terms of Service (“Terms”) govern your access to and use of our non-clinical services, interfaces, and properties, including but not limited to websites, mobile applications, software, email, social media, and any other service or product offered therein (collectively, the “Service”) that are owned or controlled by Rain Eyecare LLC, a Nevada limited liability company (“Rain,” “Company,” “we,” “us,” or “our”). Our website is FeelRain.com (the “Site”).
PLEASE READ THESE TERMS CAREFULLY. These Terms affect your legal rights and obligations; include limitations of liability; require indemnification; and require arbitration of most disputes (and include a class action waiver).
By clicking “accept,” creating an account, purchasing, or otherwise using the Service, you acknowledge that you have read, understand, and agree to be bound by these Terms and our Privacy Policy (incorporated by reference). If you do not agree, do not use the Site or Service.
Age requirement: Our Site and Service are only for users who are eighteen (18) years of age or older. If we learn we collected personal information from someone under 18, we will delete it.
We may change these Terms at any time. Changes are effective upon posting. Continued use means you accept the updated Terms.

2) Medical services and related advice (Important)
RAIN DOES NOT PROVIDE MEDICAL ADVICE OR MEDICAL CARE.
Rain provides an online platform that helps connect you with independent, licensed healthcare providers participating in the TelegraMD healthcare provider network (each, a “Provider”). Providers may deliver clinical services via synchronous and/or asynchronous telehealth technologies. Providers are independent and are responsible for the care they provide, including clinical decision-making and the standard of care.
Your relationship for clinical care is between you and your Provider, not Rain. Rain does not recommend or endorse any particular Provider, medication, pharmacy, product, or procedure.
Not for emergencies: The Site and Service are not for medical emergencies or urgent situations. If you think you have an emergency, call 911 or go to the nearest emergency room.
The content on the Site (including text, images, videos, graphics, and other materials) is for informational purposes only and is not medical advice.
3) Telehealth risks
By using the Service, you acknowledge risks associated with telehealth, which may include:
- information transmitted may be insufficient for appropriate clinical decisions (e.g., unclear images);
- delays due to technology failures or connectivity issues;
- lack of access to your complete medical records may result in adverse outcomes (e.g., interactions/allergies);
- security protocols may fail, causing a privacy breach; and
- some communications (like text messages) may be less secure than others.
4) Prescription policy / Pharmacy choice
If a Provider determines a prescription is appropriate, prescribing is solely the Provider’s professional judgment, subject to applicable law. There is no guarantee you will receive a prescription.
You agree that any prescription you obtain is for your personal use only, and you will read all medication information and labels and contact a clinician or pharmacist with questions.
Pharmacy fulfillment: If prescribed, your medication may be dispensed by our dispensing partner, The Pharmacy Hub, or another licensed pharmacy, as applicable.
Freedom of choice: Where required by law, you may request that your prescription be sent to the pharmacy of your choice.
5) Not an insurance product
Rain and Providers are not insurers. Amounts you pay are not insurance premiums. The Service is not health insurance.
6) Availability / Eligibility / Location restrictions
The Service may not be available in all states and is subject to state and federal regulations. You represent that you are not barred from using the Service under applicable law and that you are located in a jurisdiction where the Service is offered. The Service is not intended for use outside the United States.
7) Payments, subscriptions, and ordering
7.1 Payments
When you participate in the Service or purchase products, you agree to pay all applicable fees. By submitting payment information, you authorize us (or our payment processors) to charge the amount due.
You are responsible for fees charged for pharmacy services and dispensing/shipping (as applicable). We may require full payment before products ship.
7.2 Subscriptions and auto-renewal (if offered)
If you purchase a subscription, it will renew automatically at the end of each subscription period unless you cancel before the renewal date through your account settings or by contacting Support.
We may change subscription prices from time to time and will provide notice as required by law. Price changes take effect at the start of the next subscription period.
7.3 Order acceptance, shipment, and timing
Placing an order does not guarantee acceptance. We may request additional information. If we cannot ship within a reasonable time after receiving a properly completed order (including any required clinical review and prescription approval for RX products), we may cancel the order and notify you.
When a scheduled billing/shipping date falls near weekends/holidays, shipments may be processed earlier to align with pharmacy hours and carrier pickup.
7.4 Pricing errors
If a product or service is listed at an incorrect price due to error, we may refuse or cancel the order. If you were charged, we will issue a credit/refund to the original payment method for the incorrect charge amount.
7.5 Risk of loss
Risk of loss and title for shipped products pass to you when the products are delivered to the carrier.
7.6 Returns and refunds
Returns and refunds are governed by our Refund & Return Policy and/or any policy posted on the Site, as updated from time to time.
8) Account, site access, security, and restrictions
To access certain features, you may need an account (“Account”). You agree to provide accurate, current information and to maintain confidentiality of your Account credentials. You are responsible for all activity under your Account and must notify us of any unauthorized use.
You agree not to:
- violate site security, probe or test vulnerabilities, or bypass protections;
- use scrapers, bots, crawlers, or automated means to access or copy data;
- interfere with the Site’s operation;
- impersonate others or misrepresent your affiliation; or
- use the Site or Service unlawfully.
We may suspend or terminate your access at any time, with or without notice, as permitted by law.
9) Electronic communications; e-sign consent
When you use the Site or send communications to us, you consent to receive communications electronically. You agree that notices, disclosures, and communications provided electronically satisfy legal “in writing” requirements, and that consents and agreements may be signed electronically.
10) Consent to receive calls and text messages
By providing your phone number, you agree we (and our service providers) may contact you by phone call or text for Service-related communications such as account verification, order updates, refill reminders, and care-related administrative messages.
Text messaging may be less secure. Message and data rates may apply. Message frequency varies. You can opt out by following the instructions in the message (e.g., replying STOP), though opting out may limit important updates.
11) Ownership of the Service and content; User content
Except for your electronic medical record (which is maintained by or on behalf of Providers as applicable), the Service and its content—including designs, text, graphics, logos, software, and other materials (“Content”)—are owned by Rain or its licensors and protected by intellectual property laws.
You may not copy, modify, distribute, sell, reverse engineer, or exploit the Service or Content without written permission.
If the Site allows you to submit reviews, comments, or other content (“User Content”), you grant Rain a perpetual, worldwide, royalty-free license to use, reproduce, modify, and display that User Content in connection with the Service. You are responsible for User Content you submit.
12) Accuracy of information; functionality
We try to keep the Site accurate, but we do not guarantee the Site or product/service descriptions are error-free. We may update or change the Site at any time.
13) Links to third-party sites
The Site may link to third-party websites (“Linked Sites”). We do not control and are not responsible for Linked Sites. Access Linked Sites at your own risk.
14) User information; prohibited submissions
If you submit health information, medical history, images, messages, or other materials (“User Information”), you agree:
- not to submit false, unlawful, or harmful content;
- not to violate others’ privacy or intellectual property rights;
- not to transmit malware; and
- that you have the legal right to provide the User Information.
You agree to defend, indemnify, and hold harmless Rain (and, as applicable, Providers and partners) from third-party claims arising from User Information you submit in violation of these Terms.
15) Copyright policy (DMCA)
We comply with the Digital Millennium Copyright Act (“DMCA”). If you believe content on the Site infringes your copyright, you may submit a DMCA notice. We may remove content and terminate repeat infringers.

16) Disclaimer of warranties
THE SITE AND SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED.
17) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAIN WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAIN’S TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE AMOUNT YOU PAID TO RAIN FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some states do not allow certain limitations, so these limits may not apply to you in full.
18) Indemnification
Except where prohibited by law, you agree to indemnify, defend, and hold harmless Rain, its officers, directors, employees, agents, affiliates, and service providers from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site/Service; (b) your violation of these Terms; or (c) your User Content/User Information.
19) Governing law
These Terms and any dispute arising from them are governed by the laws of the State of Nevada, without regard to conflict of laws principles.
20) Arbitration agreement (binding) and class action waiver
20.1 Mandatory arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Service (including purchases) will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (as applicable), except as stated below.
You and Rain waive the right to a trial by jury and to participate in a class action.
20.2 Notice of dispute
Before starting arbitration, you must send a written notice describing the dispute and the relief sought to:

If we don’t resolve within 30 days of receiving the notice, either party may start arbitration.
20.3 Arbitration location / procedure
Unless you and Rain agree otherwise, arbitration will take place in Clark County, Nevada, or may be conducted by phone/video or solely on written submissions, depending on the AAA rules and the nature/amount of the claim.
20.4 Small claims option
Either party may bring an individual action in small claims court instead of arbitration, if eligible.
20.5 Class action waiver
YOU AND RAIN AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
If this class action waiver is found unenforceable, then any class claims must be brought in a court of competent jurisdiction in Clark County, Nevada (to the extent permitted by law), and not in arbitration.
21) Third-party rights
Except as expressly stated, these Terms do not confer rights or remedies on any third party.
22) Assignment
You may not assign these Terms without our written consent. We may assign these Terms freely.
23) Force majeure
We are not liable for delays or failures due to events beyond our reasonable control (e.g., natural disasters, pandemics, war, labor disruptions, network failures).
24) Miscellaneous
If any provision is held invalid, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver.
These Terms (together with any policies incorporated by reference) are the entire agreement between you and Rain regarding the Service.
